Estate Planning Red Flags
2009
- Your child is on the title to your home or other assets
- You’re planning required minimum distributions from your retirement accounts
- You make (or receive) “deathbed” gifts
- Your power of attorney isn’t all that powerful
- You’re transferring S corporation stock to an ineligible trust
2008
- Your estate plan doesn’t provide for sufficient liquidity
- You don’t have a gifting plan
- You haven’t funded (or fully funded) your living trust
- Your company uses EOLI and you’re unfamiliar with PPA provisions
- Your assets haven’t been valued by an independent appraiser
- Your estate plan benefits your grandchildren or other “skip” persons

- Your required IRA distributions are more than you need
- You don’t have an advance medical directive
- You haven’t left final instructions for your family
- You haven’t discussed your plan with your family
- Your estate plan leaves everything to your spouse

- Your trust is unclear about how to remove a trustee
- Most of your wealth will pass through beneficiary designations

- Newly acquired property isn’t titled to your living trust
